Eligibility & Accounts

Eligibility
You must be legally capable of entering into a binding agreement to use Fanaket. If you are under the age required to enter into contracts in your jurisdiction, you may only use Fanaket with the involvement and permission of a parent or legal guardian.

Account Information
You are responsible for providing accurate and current information when creating and maintaining your Fanaket account. You are also responsible for maintaining the security of your account credentials and for activity conducted through your account.

Account Use
You may not impersonate another person, create accounts for fraudulent or deceptive purposes, misuse another member's account, or use Fanaket in violation of applicable laws or these Terms.

Fanaket's Marketplace Role

Fanaket provides technology and marketplace services that allow independent buyers and sellers to discover items, create listings, communicate, make offers, and conduct marketplace transactions.

Sellers are responsible for the items they list, including the accuracy of descriptions, condition, authenticity, legality, pricing, availability, and fulfillment of their listings.

Buyers are responsible for reviewing listings and transaction details before making a purchase.

Unless specifically stated otherwise, Fanaket is not a party to agreements made directly between independent buyers and sellers and does not manufacture, own, possess, inspect, or guarantee items offered by independent sellers.

Seller Listings & Responsibilities

Accurate Listings

Sellers must provide accurate and complete information about items they offer on Fanaket, including condition, authenticity, price, photographs, description, and any known defects or important details that could affect a buyer's decision.

Seller Responsibility

Sellers are responsible for having the legal right to sell the items they list and for complying with applicable laws, regulations, and Fanaket policies.

Prohibited Listings

Sellers may not list illegal, stolen, counterfeit, fraudulent, dangerous, or otherwise prohibited items. Fanaket may remove listings that violate these Terms, Community Standards, or other Fanaket policies.

Order Fulfillment

When a seller accepts or completes a transaction, the seller is responsible for properly packaging and shipping or otherwise delivering the item as represented and within any applicable timeframe communicated through Fanaket.

Purchases & Buyer Responsibilities

Review Before Purchasing

Buyers are responsible for reviewing an item's description, photographs, condition, price, shipping information, and other transaction details before completing a purchase.

Payment

Buyers must provide valid payment information and are responsible for amounts they authorize in connection with purchases made through Fanaket.

Receiving & Inspecting Items

Buyers should inspect delivered items promptly and report eligible transaction problems through Fanaket within the applicable inspection or dispute period.

Fraudulent Claims

Buyers may not misuse Fanaket's dispute, refund, payment, or protection systems or knowingly submit false claims regarding a transaction.

Payments & Fees

Payments

Purchases made through Fanaket may be processed by third-party payment service providers. Users may be required to provide payment, identity, tax, or other information required to process transactions or comply with applicable laws.

Seller Fees

Fanaket may charge sellers fees for transactions or optional services. Any applicable fees will be disclosed before they are charged or made available through Fanaket's seller tools, fee information, or other applicable notices.

Taxes

Users are responsible for taxes they are legally required to pay in connection with their activity on Fanaket. Fanaket or its service providers may calculate, collect, report, or remit certain taxes when required by law.

Offers & Transactions

Offers

Buyers may be able to submit offers to sellers. Sellers may accept, decline, or counter an offer where those features are available. Additional terms displayed during the offer process may apply.

Completing Transactions

Users agree to complete transactions in good faith and not manipulate purchases, offers, payments, shipping, feedback, or other marketplace systems.

Off-Platform Transactions

Users may not use Fanaket primarily to locate another member and then intentionally move a transaction outside Fanaket for the purpose of avoiding applicable Fanaket fees, protections, or marketplace procedures.

Cancellations, Refunds & Disputes

Transactions may be eligible for cancellation, refund, return, or dispute resolution under Fanaket's applicable Buyer & Seller Protection policies.

Eligibility may depend on factors including the transaction status, delivery status, item received, reason for the claim, information provided by the buyer and seller, and applicable law.

Fanaket may request photographs, tracking information, communications, or other evidence when reviewing a transaction problem.

Where Fanaket provides a dispute-resolution process, users agree to participate honestly and provide accurate information. Fanaket may take action based on the information reasonably available during its review.

Shipping & Delivery

Seller Shipping Responsibilities

Sellers are responsible for shipping sold items within the timeframe required or communicated through Fanaket. Sellers must package items appropriately and provide accurate shipping information.

Tracking & Delivery

When tracking is required or available, sellers should provide valid tracking information. Delivery status provided by the applicable shipping carrier may be used when evaluating transaction completion or disputes.

Shipping Problems

Buyers and sellers should promptly report eligible lost, damaged, missing, or incorrectly delivered orders through Fanaket's support or dispute process. Resolution may depend on tracking information, carrier records, transaction evidence, and applicable Fanaket policies.

Prohibited Conduct

Users may not use Fanaket to engage in fraud, scams, harassment, threats, illegal activity, deceptive practices, payment manipulation, spam, impersonation, or attempts to compromise another user's account or personal information.

Users may not interfere with Fanaket's operation, attempt unauthorized access to Fanaket systems, abuse marketplace features, manipulate ratings or feedback, or use automated methods to access or collect information from Fanaket except where expressly permitted.

Users must also comply with Fanaket's Community Standards and other applicable policies.

Intellectual Property

Fanaket Content

Fanaket's name, branding, logos, website and application designs, software, and original platform content are owned by or licensed to Fanaket and may not be copied, reproduced, distributed, or used without authorization except as permitted by law.

User Content

Users retain ownership of photographs, descriptions, messages, and other content they submit to Fanaket, subject to any rights they grant Fanaket under these Terms.

By submitting content to Fanaket, you grant Fanaket a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, and use that content as reasonably necessary to operate, improve, promote, and provide Fanaket and its marketplace services.

Users must have the necessary rights to content they upload and may not use Fanaket to infringe another person's copyrights, trademarks, or other intellectual property rights.

Account Restrictions & Termination

Fanaket may remove content, restrict marketplace features, suspend accounts, or terminate accounts when reasonably necessary to protect users or the marketplace, enforce these Terms or Fanaket policies, address suspected fraud or illegal activity, comply with legal obligations, or respond to serious or repeated violations.

Users remain responsible for obligations arising from transactions or activity that occurred before an account was restricted, suspended, or terminated.

Service Availability & Disclaimers

Fanaket works to provide a reliable marketplace experience, but the services may occasionally be unavailable, interrupted, modified, or discontinued.

To the extent permitted by applicable law, Fanaket does not guarantee that the services will always be uninterrupted, error-free, secure, or that every listing, seller, buyer, transaction, item, or user-provided statement will be accurate or reliable.

Users are responsible for evaluating marketplace listings and making their own purchasing and selling decisions.

Limitation of Liability

To the fullest extent permitted by applicable law, Fanaket and its owners, affiliates, officers, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to the use of Fanaket.

Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded or limited.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Fanaket and its owners, affiliates, officers, employees, agents, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from your violation of these Terms, violation of applicable law, infringement of another person's rights, or misuse of Fanaket.

Changes to Fanaket or These Terms

Fanaket may modify, update, add, or discontinue features of the marketplace as the service develops.

These Terms may also be updated from time to time. When changes are made, the updated Terms will be posted with a revised “Last Updated” date. Where required by applicable law, additional notice will be provided.

Your continued use of Fanaket after updated Terms become effective constitutes acceptance of those changes to the extent permitted by applicable law.

Governing Law & Disputes

These Terms and disputes relating to Fanaket will be governed and resolved in accordance with applicable law.

Additional dispute-resolution procedures, jurisdiction provisions, or other legally required terms may apply depending on your location and the nature of the dispute.
